For any questions you may have, do not hesitate to contact us. <\/p><p>The National Central Health Procurement Authority (EKAPY) (hereinafter referred to as &#8220;the Organization&#8221;), based in Athens (Averoff 12, Athens 10433), with a contact phone number 2132037546 and email protokollo@ekapy.gov.gr acts as a Data Controller in the context of the processing of this notice.<\/p><p>Please read this text in order to be informed in detail about the terms of the processing of your data, as provided for in the General Data Protection Regulation EU 679\/2016 (hereinafter &#8220;GDPR&#8221;).<\/p><p>If you wish to contact for any issue related to the processing of your Data and the exercise of your rights, you can contact the Data Protection Officer (DPO) of the Organization at gdpr@moh.gov.gr email address.<\/p><ol><li>The management and protection of the personal data of the visitor of the website <a href=\"https:\/\/ekapy.gov.gr\/\">gov.gr<\/a>EKAPY is subject to the terms of this Personal Data Protection Policy as well as to the provisions of national, EU and international law regarding the protection of the individual from the processing of personal data, as in force from time to time. As of 29-08-2019, Law 4624\/2019 (Government Gazette 137 A&#8217;) is in force and is being implemented in accordance with the General Data Protection Regulation (EU 2016\/679) of 25.5.2018, as well as the Directive (EU 2016\/680) of the European Parliament, which strengthens the framework for the protection of data subjects with regard to the processing of personal data in the European Union. EKAPY, with respect to personal data, complies with the General Data Protection Regulation and the applicable national legislation in the context of its activity and purpose and takes the provided and available technical and organizational measures in accordance with the provisions of the General Data Protection Regulation and the Greek legislation by extension. The term &#8220;personal data&#8221;, as used in this Policy, refers to information of natural persons, whether individuals or professionals, such as name, postal address, e-mail address, contact telephone number, etc., which can be used to identify a visitor to the website (hereinafter &#8220;Personal Data or Data&#8221;).<\/li><li><g id=\"gid_0\">What is Personal Data Processing?<\/g> Processing of Personal Data is the collection, registration, organization, storage, adaptation, alteration, retrieval, search for information, use, transmission to third parties, dissemination, association, combination, restriction, deletion and destruction of Personal Data of natural persons. <\/li><li><g id=\"gid_0\">What data do we collect?<\/g> When you visit and navigate our website, we collect your personal data that you choose to provide to us during your browsing, such as your subscription to the Newsletter or the website&#8217;s contact form. In addition, any of your Data collected by technically necessary cookies, which are absolutely necessary for the operation of our website and are always enabled, without the possibility of deactivating them, as well as by cookies that you have consented to be used (&#8220;non-necessary cookies&#8221;) and\/or the tracking of Internet Protocol (IP) addresses, may also be processed. Detailed information about cookies can be found in the Cookies Policy, here.   <\/li><\/ol><p>In general, we do not process Data of minors, as the services of our website are not addressed to them. If we find that we have collected Data of a minor, without there being a legal basis for doing so, we will proceed to the immediate deletion of the Data. For the rest, what is mentioned in this Policy also applies to minors.  <\/p><p>Purpose of Personal Data Processing: We process your Data exclusively for the purposes of the services provided by our Organization, as well as for the general smooth operation of our website, by virtue of the following legal bases (Article 6 par. 1 of the GDPR):<\/p><p>a) there is consent of the subject to the processing of his or her personal data for one or more specific purposes, or<\/p><p>b) the processing is necessary for the performance of a contract concluded between EKAPY and the subject or to take measures following a request prior to the conclusion of a contract or<\/p><p>c) the processing is necessary for the compliance of EKAPY with its legal obligation (union law, law of the state) or<\/p><p>(d) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in it.<\/p><p>Specifically for:<\/p><p>a) to provide you with the electronic services supported by our website;<\/p><p>b) the monitoring of website traffic;  <\/p><p>c) our communication with you and the sending of a Newsletter to the email you provide through the Newsletter subscription form  <\/p><p>d) our communication with you on the information you provide through the contact form;  <\/p><p>e) ensuring information security and the proper functioning of the website;  <\/p><p>f) the creation of posts on the Organization&#8217;s website (e.g. information on Competitions, information on the Organization&#8217;s actions).<\/p><ol start=\"7\"><li><g id=\"gid_0\">Legal Basis for the Processing of Personal Data: <\/g>The processing of the data of the users of the website is done either in the context of the services offered, or is based on the consent of the user himself. Specifically: <\/li><\/ol><p>a) In order to provide you with electronic services through the website (purpose &#8220;a&#8221;), the processing is carried out because it is necessary for us to comply with obligations imposed on us by the applicable legislation, such as e.g. Law 4865\/2021.<\/p><p>b) To monitor traffic (purpose &#8220;b&#8221;), to communicate with you about issues for which you used the contact form (purpose &#8220;d&#8221;), to ensure information security and the proper functioning of the website (purpose &#8220;e&#8221;) and to make posts on the corporate website (purpose &#8220;f&#8221;), the legal basis for the processing is the pursuit of public interests of our Organization. In particular, processing for purpose &#8220;b&#8221; seeks to increase the impact of our website, processing for purpose &#8220;d&#8221; seeks to maintain effective lines of communication with transacting citizens and our partners and to increase their level of satisfaction, processing for purpose &#8220;e&#8221; seeks to ensure the proper functioning of the website,  through the use of technically necessary cookies and the protection of data and intellectual property of both the Organization and the visitors of our website and the processing for the purpose &#8220;f&#8221; seeks to effectively inform citizens about the actions of the Organization in its role as a public body. <\/p><p>c) For our communication with you and the sending of a Newsletter (purpose &#8220;c&#8221;), the processing of your personal data (email) is carried out by virtue of the explicit consent you give us for this purpose. For more information about the Cookies Policy see here. <\/p><ol start=\"8\"><li><g id=\"gid_0\">Who are the recipients of your data?<\/g> The Organization will not make available or otherwise transmit or disclose your personal data to third parties, without your consent, with the exception of the application of relevant legal dictates and to the competent authorities only. The Organization may process part or all of the data sent by visitors\/users for statistical purposes and to improve the services \u2013 information provided on the EKAPY website.  <\/li><\/ol><p>More specifically, the recipients of your data are, as a rule, the necessary, in any case, staff of the Organization, who have received due information on the secure processing of your personal data. In addition, the recipients of your data are: <\/p><p>-Natural and legal persons, to whom the Organization assigns the execution of specific tasks on its behalf, such as providers of IT application services and their maintenance. The cooperating persons, who act as processors of personal data, have been informed and committed in advance to maintain the confidentiality of your data, are aware of and follow our instructions regarding the processing of personal data and take all appropriate measures to protect them. <\/p><p>-Cooperating third parties, such as the e-Government of Social Security S.A. (IDIKA S.A.) (provider of the H-Cloud, on which the website is hosted), who act as independent Data Controllers for your data in the context of their cooperation with us.<\/p><p>&#8211; Supervisory, audit, police, prosecutorial, independent, judicial, public and\/or other authorities and bodies within the framework of their legal competences, duties and powers, when the transfer to them is required by law or provided for by it, following relevant legal requests from them in the exercise of their duties, as well as when imposed by court decisions.<\/p><p>-Lawyers, law firms, bailiffs, notaries, experts, experts, in any case of judicial actions in the context of safeguarding our rights and interests.<\/p><ol start=\"9\"><li>EKAPY may include links to other websites that are under the responsibility of third parties (natural or legal persons). In no case is EKAPY or its administrator responsible for the terms of personal data protection that these websites follow. <\/li><li><g id=\"gid_0\">How do we ensure that Processors respect your Personal Data<\/g>? The Processors have agreed and contractually committed with the Organization: <\/li><\/ol><ul><li>process your Personal Data solely in accordance with our instructions and orders;<\/li><li>to maintain confidentiality,<\/li><li>not to send Data to third parties without the permission of the Organization;<\/li><li>take appropriate security measures;<\/li><li>comply with the legal framework for the protection of personal data, in particular the GDPR.<\/li><\/ul><ol start=\"11\"><li><g id=\"gid_0\">Do we send your Data outside the EU\/EEA?<\/g> We do not send your Data outside of Greece. Your Personal Data is stored and processed only within Greece.  <\/li><li><g id=\"gid_0\">When do we delete your data? <\/g>Your personal data will only be kept for the reasonable period of time required by the nature of the data processing and only for as long as it is necessary to achieve its purpose, unless there is a legal obligation to the contrary to continue to keep them. <\/li><\/ol><p>Furthermore, the collection and processing of personal data is lawful if it is required for purposes of general legal interest or for the purposes of harmonizing our operation with National and\/or Community legislation.<\/p><p>We will retain and process your Personal Data for the purposes set out above only for as long as necessary for the purpose for which it was collected or for as long as required under applicable law. We have taken appropriate organizational and technical measures to secure and protect your Data from any form of accidental or unlawful processing. Those measures shall be reviewed and amended when necessary.   <\/li><li>What are your rights?<\/li><\/ol><ul><li>You <b>have the right to access<\/b> your Personal Data: This means that you have the right to be informed by us if we are processing your Data. If we process your Data, you can request to be informed about the purpose of the processing, the type of Data we keep, to whom we give it, how long we store it, whether automated decision-making takes place, but also about your other rights, such as rectification, deletion of data, restriction of processing and filing a complaint with the Personal Data Protection Authority. <\/li><li>You <b>have the right to correct<\/b> inaccurate Personal Data: If you find that there is an error in your Data, you can submit a request to us to correct it (e.g. name correction or telephone number change update).<\/li><li>You <b>have the right to erasure\/right to be forgotten<\/b>: You can ask us to delete your Data if it is no longer necessary for the above-mentioned processing purposes or you wish to withdraw your consent in case it is used as a legal basis for processing.<\/li><li>You <b>have the right to restrict processing<\/b>: You can ask us to restrict the processing of your Data for as long as your objections to the processing are pending or if part of the processing is no longer required to fulfil the purposes for which we collected your data.<\/li><li>You <b>have the right to object to the processing<\/b> of your Data: You can object to the processing of your Data, when it is carried out in the context of the pursuit of our public interests, and we will stop processing your Data, unless there are other compelling and legitimate reasons that override your right.<\/li><li>You have <b>the right to withdraw your consent<\/b>: In cases where the processing of your Data, for a specific purpose, is based on your prior consent to the processing, you have the right to withdraw your consent with the result that the processing will not continue in the future.<\/li><\/ul><ol start=\"15\"><li><a href=\"mailto:gdpr@moh.gov.gr\">How can you exercise your rights? <\/a>In order to exercise your rights, you can send us a relevant Organisation Request (Averoff 12, Athens 10433) to the email address of the Data Protection Officer (DPO) of the Organisation (<b>gdpr@moh.gov.gr<\/b>), with a description of your Request and we will make sure to examine it and respond to you as soon as possible. <\/li><li><g id=\"gid_0\">When do we respond to your requests? <\/g>We respond to your Requests free of charge without delay, and in any event within one (1) month from the date we receive your request.
